DMCA Policy for NextAffairs

NextAffairs (“we,” “us,” or “our”) respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have adopted the following policy toward copyright infringement.

1. Introduction

This policy is intended to guide copyright owners on how to report alleged infringements of their work appearing on the nextaffairs.com website (the “Website”). We will respond to notices of alleged copyright infringement that comply with the DMCA and other applicable laws.

2. Reporting Copyright Infringement: DMCA Takedown Notice

If you are a copyright owner or an agent thereof and believe that any content on our Website infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Designated Copyright Agent with the following information in writing:

  1. Identification of the Copyrighted Work: A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the Infringing Material: A description of the material that you claim is infringing and where it is located on the Website. Please provide URLs and any other details sufficient to permit us to locate the material.
  3. Your Contact Information: Your name, mailing address, telephone number, and email address.
  4. A Statement of Good Faith Belief: A statement by you that you have a good faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law.
  5. A Statement of Accuracy: A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.
  6. Your Signature: A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright that is allegedly infringed.

Failure to include all of the above information may result in a delay in processing your DMCA notification.

3. Counter-Notification Procedure

If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may file a counter-notification with us. To be effective, a counter-notification must be a written communication provided to our Designated Copyright Agent that includes substantially the following:

  1. Identification of Removed Material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  2. A Statement Under Penalty of Perjury: A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  3. Your Contact Information: Your name, address, telephone number, and email address.
  4. Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside of the United States, for any judicial district in which NextAffairs may be found), and that you will accept service of process from the person who provided the original infringement notification or an agent of such person.
  5. Your Signature: Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward it to the notifying party who submitted the original DMCA claim. The original claimant will then have ten (10) business days to inform us that they have filed a legal action seeking a court order to restrain you from engaging in the infringing activity. If we do not receive such notification within ten (10) business days, we may reinstate the material.

4. Policy on Repeat Infringers

NextAffairs takes copyright infringement very seriously. In accordance with our policy, we may, in appropriate circumstances, terminate the accounts or access of users who are determined to be repeat infringers.
